Introduction and Acceptance of the Terms and Conditions
The general Terms and Conditions of Sale detailed below govern the contractual relationship between the ‘User’ (hereafter also referred to as ‘You’ or the ‘Customer’) and ‘ME&MY Pty Ltd’ (hereafter also referred to as ‘We’ or the ‘Website’) ABN – 44 153 260 425. Both parties accept these Conditions unreservedly. These general Conditions of Sale are the only conditions that are applicable and replace all other conditions, except in the case of express written, prior dispensation. We maintain that, by confirming your order, you have read and do unreservedly accept our general Conditions of Sale. These Terms and Conditions of Sale are important to you and ME&MY Pty Ltd as they are used to protect your rights as a valued customer and our rights as a business.
Changes to the Terms of Service and the Website
We reserve the right to update the Website and these Terms of Service from time to time, at our discretion and without any notice. It is solely your responsibility to keep up-to-date with the latest Terms and Conditions by checking back regularly. Your continued use of the Website following the publishing of updated Terms of Service will be taken to mean that you have read and agree to the changes.
Access to the Website
We reserve the right to close the Website for short periods of time for regular updating of products and for general maintenance. We will not be liable if for any reason all or any part of the Website is unavailable at any time.
Parts of the Website require you to input a login to access certain features. This is to be able to give you details relevant to your order whilst still keeping them private to you. To do this, as part of our security procedures, we require you to register an account by entering your email and choosing a secure password. We highly recommend that you choose a strong password that is hard for others to guess, and you log out from your account at the end of every session. There is a password reset procedure in case you forget your password. You must treat your account log-in information as confidential, not disclosing it to any third party and only using memyhair.com in person. If you think there may have been any breach of security then it is your responsibility to notify us immediately and if log-in is possible, to change your password.
It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. We reserve the right to disable any user account at our sole discretion.
SSL encrypted browsing is available for our checkout pages, but while we strive for this, we cannot guarantee that all use will be secure. While we work hard towards this, we also do not guarantee that the Website or any content provided on the Website is error free. We manage your personal data according to our Privacy Guarantee.
All products sold on the Website come with a legal guarantee concerning product conformity, as outlined in the following legal clauses. Pursuant to the legal guarantee concerning product conformity.
To comply with the terms of the contract, products must:
1) Match the description given on the website.
2) Be suitable for the purpose usually associated with such a product, or be suitable with any other purpose required by the customer.
3) Have the features and purpose that customers would expect from such a product, given the product type and description on the website.
The legal guarantee concerning product conformity does not apply in some cases:
– when damage is caused by external factors including but not limited to heat, being dropped, incorrect storage.
– when damage is caused by the customer’s non-respect of the manufacturer’s instructions regarding the use of the product.
– when damage is caused by the customer’s misuse of the product.
– when the customer is aware of damage to the product at the time of placing their order.
ME&MY will not be held liable for poor use and its consequences on the products purchased from the Website. The end user is responsible for ensuring their own compatibility and safety with purchased products.
All the content on the ME&MY website (illustrations, texts, names, brand names, images and videos) is the property of ME&MY. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by ME&MY.
Waiver and Severability
Any failure of ME&MY to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and ME&MY, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.
Speedy delivery is a must when you want your hair products asap so we’ve given you a choice of courier or Australia Post services (wholesale account orders are always sent via courier unless otherwise arranged).
For individual purchases we understand we may not have a stockist near you for a local pick up so if you spend over $50 we’ll send your order with free shipping!
We aim to send your order the same day but as we are a small business sometimes it may not be possible but we always ensure orders are despatched within 2 business days. Depending on where you are delivery is typically within 2-5 working days from date of despatch. We aim to notify you at every step of the process so you’ll know where your order is.
Should your goods arrive damaged or be lost in transit we will replace the order at no expense to you, evidence of damage may be required. For damaged goods please notify us within 3 business days of receipt of delivery. Should your order not arrive within 2-5 working days from date of despatch please notify us immediately. Late or lost deliveries will require an investigation before a replacement is arranged.
We accept international orders and freight will be calculated based on Australia Post rates, all prices shown are in Australian Dollars. International orders can take up to 2 weeks to be delivered so please be patient! We do our best to get it to you quickly but rely on the postal service.
We do our best to ensure we have all products in stock however on occasion we may not be able to supply the product/s you are after. Should this be the case and you have ordered other products the WHOLE order will be placed on backorder and despatched as soon as all stock is available. Should you wish for the rest of your order to be despatched and not wait for stock to be available please make a note on your order and the backorder will be placed separately with a secondary freight charge applicable. We usually don’t delete lines from our range, however, should this occur and we are unable to supply an item you have paid for you will be offered a full refund or exchange for a similar item. Exchanges/replacements/refunds will be completed within 14 days.
We are positive you will love your ME&MY products and are here to help and ensure you get the most out of the products you order.
However, should you wish to return any unused products (excluding faulty goods) we will refund the cost of the goods upon receipt of returned stock. Please notify us within 2 weeks of receipt of the goods if this is the case. A refund can not be provided until goods have been received by ME&MY. Should return goods be lost in transit we can not take responsibility for these goods.
If the products have been used and you are not happy with any aspect we ask that you consult with a ME&MY representative who will be able to arrange replacement products suited to your hair type or if none are available a refund will be offered. We do ask that if this is the case you consider the environment and provide your unused portion to a friend or family member to try rather than throwing it away.
If any product is faulty or not as described a full refund or replacement will be provided.

Our online payment system is protected by encryption so that we can guarantee that no one can access your credit card details.

If you choose to set up an account/log in with us the only information we use in relation to you is to identify your orders, shipping and payment details and provide you with communication from us. We will not provide or sell your information to a third party.
Our site cookies allow you to easily log in and view your history in order to provide you with an easy shopping experience. We do not use any of this information other than to provide the best possible service to you. If only cookies had stayed as simple as the choc chip variety!

Prices shown are in Australian Dollars and include GST. Whilst we aim for perfection sometimes we make mistakes and can not guarantee that all images, prices and product information are totally correct at all times. If a price is incorrect we will honour prices indicated where possible. If at any time a price is well under our cost a refund or alternative will need to be arranged.
GST is not applicable on international orders however you may be required to pay duties or taxes once goods are imported.
Our products are available at various stockists across Australia and our online pricing is shown at the recommended retail price as defined by us. We believe in supporting small local businesses and as such will not discount below our stockists unless running a special promotion or offer for a limited time.
